General Terms

1. Scope of application

These terms of use are entered into by and between You («Purchaser» of the Zurich Gift Card) and the Association of Zurich Specialty Stores («VZS»). Opposed conditions from purchasers as for example general conditions of purchase etc. are overruled.

 

2. Product: Zurich Gift Card

The gift card is a non-personal and transferable debit card that can be loaded with any desired amount of money, starting from CHF 50.-. The gift card can only be used as a means of payment at businesses who are part of the VZS or confirmed by the VZS to be partners. Reloading the card is only possible at businesses which are designated as points of sale of the gift card or at VZS’s registry. An overview of the participating businesses and points of sale can be viewed on the internet at www.zuerich-geschenkkarte.ch under the section headed «Businesses» 

 

A cash payment of the card balance is explicitly excluded and not possible.

 

The depiction of the gift card on the website www.zuerich-geschenkkarte.ch is for information only and without responsibility, as its sole function is an invitation to purchasing the card. We reserve the right to changes in price and assortment of the card as well as technical changes.

The VZS reserves the right to decline the purchase of a card without having to provide reasons for the action taken.

By ordering a gift card and accepting these general terms, the purchaser makes a legally binding offer for the conclusion of a contract. The conclusion of the contract is valid from the moment the VZS completes the order. The order confirmation is usually sent via e-mail. Once an order has been confirmed, it cannot be changed or cancelled by the purchaser.

 

3. Pricing

All prices are in Swiss francs (CHF), including value added tax and commission costs. The right to changes in the pricing of the card is reserved. For the products ordered by the purchaser, the prices that are named on the order confirmation are valid. The order can only be paid in Swiss francs.

 

4. Delivery and shipping costs

The shipping costs must be paid by the purchaser. The card will be delivered directly to the address cited by the purchaser. Delivery time can take up to ten working days. The VZS is not liable for delayed delivery. A pickup by the purchaser in person is only possible if so agreed upon with the VZS in advance.

The shipping costs are at the expense of the customer.

 

5. Terms of payment

We deliver only with payment by payment in advance. VZS has the right but not the obligation to send the gift card for payment against invoice. The VZS has the right to block the card until the receipt of the invoice.

 

 

6. Non-refundable

The gift card cannot be exchanged or returned and the amount loaded onto the card cannot be refunded.

 

7. Complaints and returning of the card

If you receive a card with clearly visible defects, the purchaser must complain by letter immediately and no later than eight (8) days after the receipt of the delivery. If you receive a card with hidden defects, the purchaser must complain by letter immediately and no later than eight (8) days after the receipt of the delivery. If the purchaser fails to complain by letter within that time frame, the guarantee expires. The observance of the deadline is measured by the date of the receipt of the written complaint.

The defected card has to be sent to the VZS with a copy of the order confirmation and a description of deficiency. All mailing costs must be paid by the purchaser.

The defected card, if it is accepted by the VZS as a defected card, will be exchanged for another card with the same total value. A cash refund is not possible. Other claims are excluded and denied. 

 

8. Residual amount and expiration

The card’s balance can be checked online at www.zuerich-geschenkkarte.ch under the section headed «Balance query» or via SMS to the number 9234 (CHF 0.30/SMS). The card is valid for 60 months beginning with the date of purchase. After the expiry date, the total value of the card expires (Art. 128 Ziff. 3 OR). In case of loss or theft, the card will not be replaced.

 

9. Disclaimer

All liability of the VZS for direct and indirect damage is excluded under applicable law. All liability of the VZS for transmission errors and their direct and indirect consequences (including late deliveries, delivery errors and non-delivery) is excluded, regardless whether the transmission error happened on account of the VZS or the purchaser.

 

10. Applicable law and jurisdiction

In case of disputes, Swiss law shall be exclusively applicable. The court of jurisdiction will be in Zurich.

 

11. Protection of privacy

The information collected on this website will be treated as confidential. Modern security technology is used to protect purchasers’ data. ZVS is not liable for the security of data transmitted via the internet. Whenever possible, the transmission of the data is transmitted as encrypted.

12. Changes and additions

The VZS has the right to change and and add to the general terms of this website, and apply these changes to the general terms immediately.
